The "Description of Custom Home Design Services"
describes the activities & deliverables that will be delivered as part of your
Custom Home Design Service. Please
review these items carefully so that you understand the service being provided.
At the end of this list is the final
cost to complete the tasks listed in the "Description of Custom Home Design
Services".

Payment Process and Completion of Work:
A receipt for 50% of the total Custom Home Design
Service Fee is documented above. By
submitting your payment you have authorized Houseplans.com Services, Inc. and
our partner to begin work on your Custom Home Design, approving to the scope
documented in this Custom Home Design Agreement, and agreeing to all the terms
written in this Agreement.
An invoice via Paypal will be emailed at the
conclusion of Custom Home Design Service Item 6 (above) for 25% of the total
Custom Home Design Service Fee.
Payment of this invoice must be received before Custom Home Design Services can
begin Item 7 in the Description of Custom House Plans Services section above.
An invoice via Paypal will be emailed at the
conclusion of Item 9 for 25% of the total Custom Home Design Service Fee. Payment of this invoice must be
received before Custom Home Design Services can complete Item 10 in the
Description of Custom House Plans Services section above.
There are no refunds available for the Custom Home
Design service. The Client reserves
the right to stop this process at any point, and will always retain rights to
any work delivered by Custom Home Design Services under this agreement.
Additional iterations are available during the Design
Phase of this Service. Each
additional design iteration will cost $500, and will be billed and paid prior to
commencement of the additional design iteration.
Additional iterations are available during the Construction Document
Phase of this Service. Each
additional construction document iteration will be priced at the time of the
iteration request, and will be billed and paid prior to the commencement of the
additional construction document iteration.
Scope Change Process:
The
price for a Custom Home Design that is 2,000 sq. ft. or less is $3,500, if the
design request, at any time during the Design or Construction Document Process,
results in the square footage exceeding 2000 square feet, an additional $1000
fee will be due and payable. The project will be on hold until this amount is
received. The remainder of the
Custom House Plan Service Fee Billing will be carried out as discussed above in
the Payment Process and Completion of Work section of this document. The price
for house plans that are more than 2,000 sq. ft. is $4,500.
Any service or deliverable (requested by the Client) that is
outside of the scope of this agreement will be priced on a case by case basis
and handled under a separate agreement Services .
Terms of Service:
Limitation of Liability. The liability of
Houseplans.com Services Inc. and/or any third party involved in the Custom Home
Design service to the Client or any other party for any damages, legal or
otherwise, relating to this Work Order and forthcoming Customization Efforts
shall not exceed and is limited to the total fees paid by Client to Custom Home
Design Services .
Ownership. The Copyright of any ideas,
renderings, construction drawings, or other assets developed under the scope of
this Agreement remains with Houseplans.com, Services, Inc.'s designer. The Client retains the right to use
and modify the house plan developed through this Agreement, excluding the
re-sale of any ideas, renderings, or construction drawings as a "house plan"
product. Houseplans.com Services,
Inc. retains the rights to any assets developed through this agreement and may
use in any manner they deem appropriate.
Scope. The fee documented in this Agreement
only applies to the scope documented in this Agreement. Any additional scope items not
discussed in this document must be discussed separately and covered under an
additional and separate Agreement.
Governing Law, Choice of Forum. This Agreement and any dispute related to or arising under this
Agreement shall be governed by and construed in accordance with the laws of the
State of California. Any claims or legal actions by one party against the other
arising out of the relationship between the parties contemplated shall be
commenced and maintained in state or federal court located in the State of
California.
Warranties and Disclaimers. The information,
plans and specifications contained in all house plan documents are provided "as
is" without warranty, either expressed or implied, including, but not limited
to, the implied warranties of merchantability, fitness for a particular purpose,
or non-infringement. Houseplans.com Services Inc.
and/or any third party involved in the Custom Home Design service process
assumes no responsibility for errors or omissions in these pages or other
documents which are produced as a part of this Agreement.
References to corporations, services and products, are
provided "as is" without warranty of any kind, either expressed or implied. In
no event shall Houseplans.com Services Inc. and/or any third party involved in
the Custom Home Design service be liable for any special, incidental, indirect
or consequential damages of any kind, or any damages whatsoever, including,
without limitation, those resulting from loss of use, data or profits, whether
or not advised of the possibilities of damage, and on any theory of liability
arising out of or in connection with the use or performance of the information.
These documents could include technical or other
inaccuracies or typographical errors. Houseplans.com Services Inc. and/or any
third party involved in the Custom Home Design service assumes no liability for
errors or omissions in these documents.
